Living in a home overrun by pests such as rats, mice, cockroaches, or other vermin can be deeply unsettling and harmful to your health.
Not only does an infestation affect your quality of life, but it can also pose serious health risks, including the spread of disease and contamination of your living space.
If you're a tenant in social housing, such as a council property or housing association home, and your landlord has not dealt with a reported housing disrepair issue which has led to an infestation, you may have grounds for a housing disrepair claim.
We focus first on ensuring the repairs to your home are completed quickly. But we will also ensure that you receive the financial compensation you’re owed.
At SDS Solicitors, we understand the distress caused by pest and vermin infestations and the frustration that comes with landlords who fail to take action.
If your landlord has not dealt with a reported infestation, you may have grounds for a housing disrepair claim to seek both repairs and compensation.
Pests such as rats, mice, cockroaches, and bedbugs can quickly become a serious problem in your home, often making their way inside through gaps in walls caused by Damaged Brickwork & Stuctural Disrepair, faulty drainage systems, or other defects that leave the property vulnerable. These issues are usually a result of structural disrepair, which your landlord is responsible for addressing.
Under UK law, landlords must ensure their properties are maintained in a safe and habitable condition, including taking action to prevent and resolve infestations that could harm your health and well-being.
Living with a pest infestation can be extremely distressing and disruptive. Pests contaminate food, spread disease, and create unsanitary living conditions. Rodents can chew through wires, increasing the risk of electrical faults, while cockroaches and bedbugs can be difficult to eliminate, causing ongoing discomfort and inconvenience. For many tenants, the presence of pests can lead to stress, anxiety, and even health problems such as allergic reactions and respiratory issues.
If you have reported disrepair issues to your landlord and their failure to act has led to a pest infestation, this is a breach of their legal obligations. No tenant should have to live in these conditions, and if your landlord refuses to take responsibility, you may be entitled to make a housing disrepair claim.
At SDS Solicitors, we can help you take action to ensure the necessary repairs are carried out and that you receive the support and compensation you deserve.
As a tenant in social housing, your landlord is bound by the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018. These laws require landlords to ensure that homes are free from health hazards, including infestations. Your landlord must address the root cause of the infestation, whether it is a structural defect, poor waste disposal, Leaking Pipes Housing Disrepair creating persistent moisture, or another issue that is attracting vermin or allowing them to enter the property.
Under the Housing Health and Safety Rating System (HHSRS), infestations are considered a serious hazard, and landlords are expected to take immediate action when notified. Failure to do so could entitle you to compensation for the inconvenience, financial loss, and health impact caused by their negligence.

Yes, your landlord is responsible for ensuring the property is safe and habitable from the beginning of your tenancy. If the infestation was already present, you could still have grounds for a claim.
The amount of compensation depends on the severity of the infestation and how it has affected you. This could include damages for inconvenience, health issues, and any financial losses you have incurred.
